Startup visa options

Here are six critical options for your startup:

  • E-2 Treaty Investor Visa: For entrepreneurs from treaty countries who invest substantial capital in a U.S. business. You can stay if your business remains operational and profitable.
  • L-1 Intracompany Transferee Visa: This visa allows you to transfer from your foreign business to a new or existing U.S. office in a managerial or executive role. It is an initial one-year grant with possible extensions.
  • O-1 Visa: For individuals with extraordinary business, science or arts abilities. Requires a proven track record of significant achievements.
  • H-1B Specialty Occupation Visa: This visa is for highly skilled professionals with higher education degrees. You can sponsor workers for this visa, but it has an annual cap.
  • EB-5 Immigrant Investor Program: Requires a minimum investment of $1.8 million (or $900,000 in targeted areas) and creates at least 10 full-time U.S. jobs. Leads to a green card.
  • International Entrepreneur Rule (IER): This rule allows entrepreneurs to stay up to five years to grow startups with significant potential. You don’t need a visa if you qualify.
