Why you should provide advanced notice when terminating employees

Many Illinois employers believe that they must give employees advanced notice before firing them. It might surprise you to learn that Illinois and federal law do not require employers to give any notice before terminating employees. 

Moreover, Illinois is an “employment-at-will” state. This means either an employer or employee can end their working relationship at any time, without reason, cause or advanced notice. 

However, even if you do not have to provide advanced notice, doing so can lead to certain benefits: 

Demonstrating professionalism 

Providing employees with advanced notices can help enhance your company’s reputation as an ethical employer. More specifically, it demonstrates your respect for employees, which can also improve your company culture. 

Improving employee morale 

Offering advanced notice can have a positive effect on the morale of the entire workforce. It shows remaining employees that your company values its staff and doesn’t make hasty decisions about people’s livelihoods. 

This approach can reduce anxiety among staff members about sudden job loss, as they see that the company handles such situations with care and consideration. 

Protecting against legal claims 

Providing advanced notice can offer some protection in case of claims or lawsuits. Courts or labor boards may look favorably upon employers who give reasonable notice, as it shows an attempt to mitigate the impact of job loss on the employee. 

Furthermore, a notice of termination can include the reason for firing the employee. This document can serve as evidence if the employee files a wrongful termination claim.  

For example, if the notice specifically cites poor job performance as the reason, your business may have a stronger defense when the employee sues for discrimination. 

While a notice does not guarantee protection against all legal challenges, it can be a significant factor in your company’s favor if disputes arise. 

Allows for better company planning 

A departing employee often creates a hiccup in the workflow, but giving advanced notice can help your company get ready for the change. For example, you have more time to figure out: 

  • Who will take over the employee’s tasks 
  • How to change the team structure, if necessary 
  • What paperwork does the human resources department need to prepare 

With more time to prepare, you can handle the whole process easier and reduce confusion for everyone involved.
